United States Supreme Court Rejects Hearing Challenge to Case Upholding ERISA Preemption
The United States Supreme Court has rejected hearing the challenge that the American Dental Association (ADA) had supported over a United States Court of Appeals for the Tenth Circuit case that upheld ERISA preemption of an Oklahoma pharmacy benefits law. The Supreme Court refused to grant certiorari in the case -- Mulready v. Pharmaceutical Care Management Association. This lets the Tenth Circuit decision stand on ERISA preempting the Oklahoma law that was directed at regulating pharmacy benefit mangers (PBMs). The Trump Administration, contrary to the ADA, had argued that the Supreme Court should reject hearing the case and leave the Tenth Circuit ERISA preemption ruling in place.
ADA pleads with Supreme Court for insurance reform
Federal ERISA law should not supersede states’ authority. The ADA is asking the U.S. Supreme Court to review a decision from a lower appeals court on the Employee Retirement Income Security Act of 1974 that limits states’ traditional authority to regulate health care and insurance.
